Apple is seeking $15 million in legal fees from Samsung
Through substantial documentation, Apple filed a legal submission regarding its ongoing legal battle with Samsung. This action took place in the Northern District of California.
In that litigation, Apple argues that the intentional violation of Apple 's intellectual property by Samsung makes it possible for the exceptional case claim, the award of attorney's fees, to be guaranteed, even though the norm in the U.S. under the current rules does not dictate it.
And what Apple is basically demanding is the recovery of everything it has lost in this long process with Samsung.
The sum is approaching $15,736,992, out of the more than $60 million spent on attorney's fees in the first California case. In that initial ruling, it was determined that two trials would resolve the dispute between the two companies (the first trial would take place in August 2012 and the second in November 2013), directly harming Apple and causing it an irreparable loss of more than $929 million.
This is why today the company is suing Samsung, so that it will reimburse $15 million of the more than $60 million spent on legal fees, from the beginning of the conflict until March 1, 2013, according to what Apple clarifies in its lawsuit.
On the other hand, it is known that Apple is not seeking to recover the costs of reviewing the process, and is only indicating the time-based charges that bill more than $100.000.
Finally, Apple listed several valid arguments supporting its claim. These included the proven infringement found in 26 of the 28 Samsung products in question, as well as the intentional, deliberate, and calculated copying of Apple 's iPhone . Apple also highlighted the significant commercial benefit Samsung has reaped despite this intentional infringement.
Let's hope that for the good of the companies, things become clearer and a mutual agreement is reached, since these legal conflicts only bring losses and bad times for both companies.
