If the phone has an associated iCloud account, you have to enter the password for that iCloud account; you can't use any account you want. Therefore, if iCloud is enabled, it doesn't matter if someone lends you their account (which I doubt anyone would) because it will still ask for the password of the already associated account. If the iPhone you "found" doesn't have any associated account, then you're fine.
In short… an iPhone has an iCloud account activated; to delete it you have to enter the correct data for that account, and then it lets you delete it; otherwise, IT CAN'T BE DONE.
