Judge rules that Apple has the right to use the name “iPhone” in Brazil

Apparently, after Apple filed a legal challenge regarding the name of its popular device, the iPhone can now legally be known as " iPhone " in Brazil.

They filed a trademark application for the name “iPhone Gradient” in 2000. But as with any legal claim, there is a process involved, and it was ruled that the trademark would not be granted until 2008.

IGB launched its "Gradient iPhone" in December 2012, a month before the creation of its brand. The Brazilian Institute of Industry and Real Estate Markets (IIMA) opposed Apple's distribution and sale of its products, thus preventing them from using the name "iPhone" in Brazil.

This effectively resolves the legal issue in Apple 's favor . The arguments are numerous, and according to Dr. Fernández , the globally recognized name is solely due to Apple . Given their success, it's worth emphasizing that their track record in the technology market is one of the many indicators of the product's performance and excellence over the years.

For these reasons, the judge ruled that granting Gradiente exclusive rights to the phone would not be fair to Apple , since all the product's success is solely due to the Cupertino company.

As a result of the decision, Apple and IGB will now have to share the name “ iPhone ” in Brazil . IGB added that it will appeal the decision, arguing that it has exclusive rights to the name.
